What is the "answer" to the rebus puzzle below and why is the rebus flawed?

JUGEMENT 

Answer:

The "answer" could be, Error in judgement, because the word is missing a D and should be spelled JUDGEMENT.

But the rebus is flawed because there is disagreement about the spelling of JUDGEMENT. Some say it should be spelled JUDGMENT (no E). The dictionary lists both spellings.
